Terms of Service
These terms cover your use of WOTS Agent. They are written to be read, and by using the software you agree to them.

What this is
WOTS Agent is software supplied by WOTS Marketing, San Antonio, Texas. It prepares message drafts for a real-estate agent, holds them for review, and sends the ones that agent approves. It is a tool for doing your own work faster. It is not a party to your client relationships and it is not your broker.
Who may use it
You must be 18 or over, be authorized by your brokerage to contact the people you load into it, and keep your sign-in to yourself. Tell us promptly if you think someone else has it.
What you are responsible for
Nothing goes out without your approval. That is the design, and it is also where responsibility sits. A draft is a suggestion; you read it, you decide, and the message that leaves is yours.
- You need permission to contact the people you contact. The software records a consent basis and refuses to message anyone marked as opted out, but it cannot know whether you had permission in the first place. That is yours, and so is compliance with TCPA, CAN-SPAM and your local rules.
- Fair housing applies to every word. Do not approve a message that steers on race, color, religion, sex, familial status, national origin, disability, or anything else protected. Drafts are screened; screening is not a substitute for reading what you are about to send.
- Check anything factual before you approve it. Prices, incentives, availability and dates change, sometimes weekly. A draft reflects what was last recorded, not what is true at the moment you press approve.
- Do not use it to send anything unlawful, deceptive or harassing, and do not load contacts you have no relationship with.
What we are responsible for
Running the service with reasonable care, telling you the truth about what it did, and not doing things behind your back. In particular: the software reports what actually happened to a message and never more. An email accepted by a mail server is reported as accepted, not as delivered or read, because acceptance is the most that can be known.
Third-party services
WOTS Agent connects to GoHighLevel, Google and Meta on your behalf. Their terms apply to their parts, and their outages are not ours to fix. Disconnect any of them at any time; features that depend on one stop working and nothing else breaks.
Your data
Your contacts and your messages remain yours. We store and process them to run the service, as described in the Privacy Policy. Ask for an export or a deletion and you get one.
Fees
Where a subscription applies, the fee, the term and the notice period are what was agreed in writing with WOTS Marketing. Nothing on this page overrides that agreement.
Ending it
You can stop using the service and ask for your account to be closed at any time. We may suspend an account that is being used in a way that breaks these terms or puts other people at risk, and we will say why. On closure your data is handled as the Privacy Policy describes.
No warranty
The service is provided “as is”. We do not warrant that it will be uninterrupted or error-free, that a message will reach anybody, or that any particular business result will follow from using it.
Limitation of liability
To the extent the law allows, WOTS Marketing is not liable for indirect or consequential loss, including lost profits or lost business. Our total liability for any claim is limited to the fees you paid for the service in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of the State of Texas, and the courts of Bexar County, Texas have exclusive jurisdiction over any dispute.
Changes
We may update these terms. For a material change we will give notice before it takes effect. The date at the top is the version in force, and continuing to use the service after a change means you accept it.
